The French version of this policy is authoritative.
Who we are
The data controller is SAS Emerging IT, 61 avenue de la Libération, 06130 Grasse, France (SIREN 909976706), publisher of https://emerging-it.com/.
Data protection officer: Philippe Candido, reachable at commercial@emerging-it.fr or by post at the address above.
“Talk to an expert” form
Data collected: your last name, email address and message (required), and, if you provide them, your first name, phone number, company, role, the needs you tick and whether or not you wish to receive our news and offers.
Purposes: to answer your request and, where relevant, prepare a proposal. If you tick the optional box provided for this, we also send you our news and offers by email. Your data is used for nothing else.
Legal basis: for handling your request, the request itself (pre-contractual steps taken at your request) and your consent, given by ticking the required box on the form. For news and offers, a separate consent, given by ticking the second box: it is optional, unticked by default, and leaving it unticked has no effect on how your request is handled.
Recipients: your request is recorded in our customer relationship management tool, HubSpot, which only our sales team consults. HubSpot acts as a processor: it handles your data on our behalf and solely on our instructions. Your data is never sold, transferred or disclosed to any other third party.
Transfers outside the European Union: HubSpot belongs to the US company HubSpot, Inc., so data may be transferred to or accessed from the United States. These transfers are governed by the EU–US Data Privacy Framework, under which HubSpot, Inc. is certified, and by the European Commission’s standard contractual clauses.
Retention: three years from our last exchange, after which your data is deleted from HubSpot. If you agreed to receive our news and offers, they are sent until you unsubscribe, and at most three years after your last contact with us.
Abuse protection
To block automated submissions (spam), the form uses technical measures that require nothing from you and set no cookies:
- your browser performs a small computation when the form opens, which is checked on submission;
- your IP address is recorded in hashed form (it cannot be recovered from what is stored), together with the time of your submissions, to limit their number; this data is erased after 24 hours at most.
This processing is based on our legitimate interest in protecting the site and our contact records. No third-party service (such as reCAPTCHA) is used.
Error monitoring
The site reports technical errors and loading times to our own monitoring tool, hosted by Emerging IT: browser and device type, page concerned, error message. No identifying data is attached (no name, email or cookie) and your browsing is not recorded. This processing is based on our legitimate interest in keeping the site working properly.
Cookies
The site sets no cookies and uses no audience measurement or advertising tools.
Only the display theme you choose (light or dark) is stored in your browser, so it is shown again on your next visit. This information stays on your device and is never sent to us.
Hosting
The site is hosted by OVH SAS, 2 rue Kellermann, 59100 Roubaix, France. Like any host, OVH keeps technical access logs (including IP addresses) as required by law. Form data, recorded in HubSpot, is handled as described above.
Links to other sites
The site contains links to other sites (LinkedIn, for example). They embed no content on our pages: those sites only collect data about you if you open them, under their own privacy policies.
Your rights
You have the right to access, rectify, erase, restrict and port your data, and to object to its processing. You may withdraw your consent at any time; for our news and offers, simply click the unsubscribe link included in every email.
To exercise these rights, write to our data protection officer at commercial@emerging-it.fr, or by post to SAS Emerging IT, 61 avenue de la Libération, 06130 Grasse, France. We will reply within one month.
If you believe your rights are not being respected, you can lodge a complaint with the CNIL, the French data protection authority (www.cnil.fr).
